While Justice hemant Gupta had dismissed the appeal against the ban by upholding the karnataka High Court's decision in the matter, a bench of Justice Sudhanshu Dhulia had a different opinion on the matter and disagreed with the burqa ban.
Told hijab ban in school was an attack on privacy
Apart from this, Justice Dhulia also talked about its impact on the education of girls. She said, the girls in these areas first do household chores and then go to school. The biggest question in my mind was the education of the girl child. Asking girls to remove their hijab before entering the school gate is an attack on their privacy, then an attack on their dignity and ultimately depriving them of secular education, he said. Justice Dhulia said that if girls want to wear hijab, even inside their classroom, they cannot be stopped if it is worn in a matter of their choice.
