'Obstacle' in transfer of divorce case, HC imposed fine!!!

A woman from maharashtra had demanded the transfer of divorce petition from mumbai to Nagpur. She had demanded that the petition be heard in nagpur, but her husband, who was living separately from her, objected showing insensitivity, after which the court imposed a fine of Rs 25,000 on him and said that this amount should be given to the wife.

According to the Times of india report, the bench of Justice Milind Jadhav said that the convenience of the woman and her difficulty are important facts on the basis of which the transfer of the case is being considered. This woman lives with her parents and does not have any employment, while the woman's husband lives in America and earns well.

The two got married in 2016. In 2019, the wife applied for alimony in the nagpur court. Her lawyer told that the husband did not follow the order while he had to pay Rs 10 lakh as alimony. The husband has been reprimanded for not following the court order. The boy's father had filed a divorce petition in 2021. He had filed the petition in Bandra, Mumbai. His lawyer had said that he would face great difficulty if the case was shifted from mumbai to Nagpur. Because the boy's parents are elderly and have health problems.

The high court said that the boy's father is only 63 years old and looks healthy. He is also constantly giving suggestions to his lawyer, which the high court also observed. After seeing this, the court said that you are opposing the woman's petition only for selfish reasons. On the other hand, on behalf of the husband, his lawyer said that the woman had a job before marriage. She used to work in Pune. Her father has retired from a government job and has a good pension. However, the high court termed this argument as prejudiced.
