The rules made for the selection of director General of police in Uttar Pradesh can be rejected. This claim has been made by former DGP and high court lawyer Sulkhan Singh. Sulkhan Singh said that this decision makes a rule. The state government has the power to make rules, so it has made the rules accordingly. But regarding the appointment of DGP, the supreme court has given a decision in march 2019 that any law, act or rule which is against the spirit of this decision will remain suspended. So this rule that is being made is completely against the spirit of that decision of the supreme Court.
Sulkhan Singh said that there were many points in the decision of the supreme court but there was also a point of appointment of DGP in it. Apart from this, there was separation of law and order and many other points and about the appointment of DGP, it was said that UPSC will prepare a panel in which the state government will send the name and UPSC will prepare a panel of three names. There is a process of UPSC in this, in which there is an officer of MHA, an officer and a member of UPSC. This panel of three people decides who will be the DGP. It is decided by looking at merit and seniority.
He said that now the panel of whoever will be appointed as DGP will have retired judges of high court, whoever the government wants to appoint as per its wish, there will be Chief Secretary, one person from UPSC will be appointed. There will be Additional Chief Secretary home and there will be a retired DGP. This is a committee of all the officials who proposes someone's name against the wishes of the chief minister and the government. This is not possible.
