The country's famous advocate and rajya sabha MP kapil sibal has given a notice to the rajya sabha Secretary General to impeach Justice Shekhar Kumar Yadav on his statement. Justice Shekhar had given a controversial statement in the high court premises on 9 December. He said, "When a judge is appointed, he takes an oath to protect the Constitution. If a judge attacks the Constitution after taking an oath to protect the Constitution, then we believe that that judge has no right to remain in that position and he should be removed. In this regard, we have presented a proposal to remove the judge."
Made this appeal to PM Modi and amit Shah
kapil sibal said, "What he has said, I believe that no politician would ever say that. This is not a political issue but an issue of protecting the Constitution and the independence of the judiciary. We urge prime minister Modi, Union home minister amit shah and the leaders of the ruling party to support us in protecting the Constitution." He said, "If he does not join us, the country should know which side he is on and which side we are on. Because there is no politics in this. No one in our country would want that the judges of the high court and supreme court give one-sided statements which lead to daily violation of the Constitution. We would like that the supreme court should also order the removal of the judge and he should not be assigned any work until a decision is taken on the proposal. 55 MPs have signed the proposal."
What did Shekhar Kumar Yadav say?
Justice Shekhar Kumar Yadav had said, "The word 'Katha Mullah' is wrong but there is no harm in saying it because it is bad for the country. They are people who provoke the public. They are people who think that the country should not move forward, we need to be cautious of them."
