Will hundreds of thousands of indian Americans and their offspring be brutally and violently deported back to India? Will their American Dream be cruelly and suddenly dashed? And will it take place despite the rhetoric of "Abki Baar, trump Sarkaar" and "Howdy Modi"?

Donald trump issued a series of executive orders, including the one that terminates citizenship by birth, as soon as he took office as the 47th President of the United States. During his inauguration speech, the US president proclaimed a state of national emergency along the southern border and declared that everyone would no longer be able to get US citizenship.

Executive Orders Signed by donald trump

Children born in the united states are now granted citizenship regardless of their parent's citizenship status. This permits non-immigrant foreigners with visas such as the H 1 B visa to bring their kids with them.

According to Donald Trump's executive order, these kids could be deported rather than being granted citizenship. Even worse, their lawfully present parents would also be deported because the US government does not wish to break the family. Therefore, parents may be expelled from the country together with their kids.

Earlier, the president had stated, "I don't want to be breaking up families, so the only way you don't break up the family is you keep them together and you have to send them all back."

Lack of US citizenship at birth

Since citizenship by birth is permitted under the US Constitution, the trump administration will need to modify it, which is not only legally challenging and time-consuming but also politically untenable.

Only two-thirds of the members present and voting in both the Senate and the house of Representatives can amend the US Constitution. Additionally, at least three-fourths of the states should ratify it.

Is the US Constitution Amendable Under the trump Administration?

In the Senate, there are 53 Republicans and 47 Democrats, while there are 220 Republicans and 215 Democrats in the house of Representatives.

The Republicans would have a very tough time getting any of the two chambers to support the Constitutional Amendment Bills.

In addition, there are 23 states with Democratic governors and 27 with Republican governors. It will be very difficult for the donald trump administration to persuade 36 states, or three-fourths of the states, to ratify the constitutional amendment proposals.

It is possible to contest this presidential order in court.

However according to analysts, donald trump has the authority to direct the Social Security Administration and U.S. Citizenship and Immigration services to refuse to process a citizen's application for a passport or Social Security number if the citizen cannot provide proof that their parents were legally residing in the country at the time of the citizen's birth.

There might be millions of indians targeted.

Indians won't be spared, though. An approximate estimate of 5.4 million indians, or 1.5% of the US population, live in the United States. Approximately 34%, or one-third, are citizens of the United States; the remainder are immigrants.

There are hundreds of thousands of indians living there on work permits or green cards, and they are still awaiting citizenship applications from the government. It is where their children are born.

Recent executive orders signed by the US President state that these individuals' children born in the US would not automatically be granted citizenship. Deportation is a possibility. Since the trump government does not want to break the family, their parents may also be deported with them.
