
Antilia Bomb Case: Sachin Waje gets setback from high court, petition claiming illegal detention dismissed
The court said, 'In no way can it be said that the petitioner (Waje) was acting under his official duties when he parked the bomb-laden car near Antilia and conspired to kill Mansukh Hiren.'
The bombay high court dismissed the petition, giving a setback to sacked police officer Sachin Waje. Sachin Waje had claimed that he was illegally detained, so he should be released immediately. However, the high court said that when Sachin Waje placed a car full of explosives near industrialist mukesh Ambani's house and conspired to kill businessman Mansukh Hiren, he was not doing his official work. Therefore, there is no need to get approval from the state government before his arrest.
This order was given by a division bench of Justice sv Kotwal and Justice SM Modak. Sachin Waje had claimed in his petition that he was illegally detained because whatever he did, he did it in an official capacity and he was one of the officers investigating the case, so before arresting him, necessary approval should have been taken from the state government, which was not taken. Sachin Waje demanded his immediate release. However, the high court bench refused to accept it. The court said, 'In no way can it be said that when the petitioner (Waje) parked the car with a bomb near Antilia and conspired to kill Mansukh Hiren, he was working under his official duties. The court said that there was no need for the National Investigation Agency (NIA) to obtain consent from the state government before arresting Waje.
It is worth noting that on february 25, 2021, an SUV car loaded with explosives was found near industrialist mukesh Ambani's South mumbai residence 'Antilia'. The SUV owner and businessman Mansukh Hiren were found dead in a creek in neighboring thane on march 5, 2021. Waze was arrested in march 2021 for his alleged role in both cases. The court said in its order that Waze had tried to persuade Hiren to accept responsibility for placing the explosives-laden vehicle but when he refused, Waze along with others hatched a conspiracy to murder him.
