An application for a student visa seems simple—until the DS-160 asks about prior marriages.  The timeline becomes complex for someone who was briefly married to an H1B holder.  The purpose of the february 2022 marriage was to start the H4 procedure.  The couple split up just before they obtained the visa.  The date was predated to six days following the marriage in order to hasten the legal separation process.  July 2023 saw the processing of the divorce.
 
The real question now arises.  Is it better to utilize the real divorce date or the backdated date of separation? More significantly, will prior H4 attempts raise suspicions?  Months after the split, the person was still requesting an H4 visa on paper. Intent could be questioned by a visa officer.  Any discrepancy in the dates could exacerbate the situation. The word of the day is transparency. To prevent future issues, the DS-160 should match legal documentation. Clearly describing the situation can help students maintain their focus while studying.
