Karkardooma court acquits Shahnawaz of murder charges…

Karkardooma court has acquitted the accused in a murder case related to delhi riots. Additional Sessions Judge Pulastya Pramachal heard the case. Mohammad Shahnawaz alias Shanu was the accused in the case registered by Gokalpuri Police. On 26 february 2020, the half-burnt body of Dilbar Negi was recovered from a warehouse in Chaman Park area of east Delhi. According to the police, Shahnawaz threw a petrol bomb in the warehouse and set it on fire, due to which Negi died due to injuries.

Karkardooma court said in its order of 24 february that a key eyewitness of the prosecution refused to see the incident, while the testimony of another witness was unstable. Also, it was not certain about the identity of Shahnawaz. However, another eyewitness refused to admit that he had seen the accused entering the warehouse at 9 pm or the rioters setting fire at that time. He also denied that he had tried to stop the rioters, but they did not listen.

Murder case related to delhi riots                                     

The court said that the warehouse owner and his family members did not tell the police the name of the accused immediately after the victim's body was found. The court raised the question and said that the delhi police had registered the FIR of the case on 28 february 2020. If the prosecution witness warehouse owner knew the name of the accused from 24 february 2020 (the day of the incident), then why did he not tell this name to the police before the FIR was registered.

Karkardooma court pronounced the order

The court termed the identification of Shahnawaz as a member of a riotous mob by the witnesses as unreliable. The court said that I think the prosecution failed to prove that the accused Shahnawaz entered the warehouse with other rioters at 9 pm and after that those rioters set it on fire. The court held that the charges against the accused could not be proved beyond doubt, hence he is acquitted giving the benefit of doubt.
