What is obscenity, its definition changed from time to time?
Obscenity is usually obscene language, pictures, videos or messages, which hurt people's religious, social or cultural sentiments. Under indian law, there are many laws regarding obscene content such as 'Indecent Representation of women Act, 1986 and IT Act.
The view of the courts on obscenity in india has changed over time. Earlier obscenity was seen only as sexual content, but now the court sees it in relation to the morality of society, order and respect of people.
For example, in 1957, the supreme court said in the 'Ranjit D. Udeshi case' that obscene content can have a bad effect on society. Some time later, in the 'Sakshi case', the court also said that one should have the freedom to express his views, but responsibility should also come with it, so that no one's feelings or freedom is violated.
What happened in the case of YouTuber Ranveer Allahabadia
31-year-old Allahabadia is also known as 'BeerBiceps'. He recently made a controversial comment on parents in a YouTube show. As soon as this statement went viral on social media, there was a huge protest.
The matter escalated so much that cases were filed against Allahabadia for his 'controversial comment'. Although he has apologized for such comments, but this has not helped him. The Supreme Court has definitely given him relief from arrest after making a harsh comment on his 'vulgar comment'. The court had said that if such statements are not obscenity then what is it. Apart from this, the Supreme Court had also issued a notice to the central government to prevent obscene content on YouTube and other social media platforms.
