Husband wanted to be free from responsibilities…?


If the mother of the minor child has a source of income, still the father will have to maintain the child. According to the Bar and Bench report, Justice Sanjay Dhar said that the fact that the mother is working does not mean that the father can be free from his responsibilities. In fact, during the hearing of a case, the person had said that he does not have enough income to maintain his minor children. This person had also argued in the court that his separated wife is working and her income is sufficient to take care of the child.


The court rejected this argument and said that being the father of the minor children, it is the legal and moral responsibility of the petitioner to maintain them. It is true that the mother of the children is a working woman and has her own income, but this does not absolve her of the legal and moral responsibility of providing for her children. The court has termed the father's argument as baseless.


This is the whole case

The magistrate had ordered this man to pay Rs 4500 each every month for the maintenance of his three children. His petition was rejected by the sessions court. Against which he had approached the High Court. The petitioner in the high court had said that his monthly income is Rs 12000. It is not possible for him to pay Rs 13500 every month. Because he also has to take care of his ailing parents. He said that the mother of the children is a teacher in a government school and has a good salary. In such a situation, the entire burden of children's expenses cannot be put on him.
