According to news agency PTI, a sessions court in mumbai has issued a non-bailable warrant against filmmaker ram gopal varma, rejecting his plea to suspend his jail sentence in the check bounce case. Earlier, on january 21, Andheri-based Judicial Magistrate (First Class) Y P Pujari had convicted ram gopal varma in this case.
The magistrate had sentenced the filmmaker to three months' imprisonment. Also, the court directed to pay around Rs 3.72 lakh to the complainant within three months. After this, the filmmaker filed an appeal in the Sessions court seeking suspension of the sentence. However, Additional Sessions Judge A A Kulkarni rejected his plea on march 4 and issued a non-bailable warrant against the filmmaker. The court took this decision after ram gopal varma did not appear in court during the hearing. The court rejected the plea to suspend the producer's jail sentence.
On behalf of ram gopal varma, his lawyer, Durendra K.H. Sharma had applied for bail in the court. The lawyer had submitted two separate applications, one for bail and the other for a stay of sentence. However due to Verma's absence, both these petitions were rejected by the court. Now the next hearing in this case will be held on July 28. During this time, the report of the execution of the arrest warrant against the producer will also be presented.
The case stems from a complaint filed by a company named Shree through Maheshchandra Mishra against ram Gopal Varma's firm in 2018, alleging that a cheque issued by ram gopal varma had bounced due to a lesser amount. The director was granted bail in june 2022 after he furnished a personal bond and a security deposit of Rs 5,000. The magistrate clarified that there would be no 'set-off' under Section 428 of the Code of criminal Procedure, as ram gopal varma was not in custody during the trial. After several hearings and legal proceedings, the court ruled against the filmmaker and said there was sufficient evidence to prove the allegations.
