Lawyer S.Aruna: Generally, in cases where husband and wife have a disagreement and seek mutual divorce, now it is enough to be separated for 6 months, and the divorce can be obtained legally. But not all litigants get a divorce within this period. If both parties do not mutually seek divorce, the respondent shall be given 90 days to file a counter-petition. With the intention of dragging out the case, if the counter-petitioner does not file a reply within 90 days, the court itself can intervene and bring the case to an end.

But like that, no family welfare court can act as if it were taken and overturned legally. This is because the purpose of family welfare courts is to protect family welfare and not to separate families. That is why couples are counseled by family counselors and psychologists during the waiting period. Moreover, if there is no amicable relationship between them, the divorce is given last.

The waiting period known as 'cooling period' which was already one year has now been reduced to 6 months. people seeking mutual divorce say, 'We have already talked to each other many times. If you feel that there will be no benefit in waiting any longer, you can legally get an instant divorce even within 30 days if you file a petition in the court saying that you need an immediate divorce.
