
Reportedly the high court has given life to Saibanna, a convict from Kalaburagi district who has been in prison for the past 30 years after being sentenced to death in the case of brutally killing two wives and a daughter. Considering the fact that Saibanna, a convict who has been in jail for the past 30 years, is now 70 years old and the government authorities have delayed for seven years and eight months in disposing of the amnesty petition, the high court ordered that the death sentence be commuted to life imprisonment.
Moreover Saibanna, who has been in solitary confinement for the past 20 years, can file a suitable application with the state government seeking amnesty. At the same time, the high court directed that if an amnesty application is filed, the state government can consider and dispose of the application on merit.
Meanwhile, Saibanna was sentenced to life imprisonment in the first wife murder case. Saibanna, who was released on parole in 1994, went to jail again after murdering his second wife and child. Kalaburagi Sessions court sentenced Saibanni to death by hanging. Later, the high court in 2003 and the supreme court in 2005 also upheld the death sentence. He filed an application in 2005 seeking amnesty from the death penalty. The petition was dismissed by the President in january 2013. As a result, Saibanna, who had applied to the high court in 2013, has been delayed for 7 years and 8 months in the disposal of the amnesty petition. Therefore, he requested to be exempted from death penalty. The high court, which examined all the documents in the case, has not given any reason for the total delay of 7 years and 8 months in considering the amnesty application submitted by the petitioner at different periods. Also, Saibanna was kept in solitary confinement in a single room in belgaum from january 10, 2003 to May 20, 2019, and spent 16 years in solitary confinement. He has already been in jail for more than 30 years. Therefore, the bench said in its order that justice would be served if the death sentence was commuted to life imprisonment and the government was given freedom to apply for clemency.
