After assuming the post of chief minister of Madhya Pradesh, Dr. Mohan Yadav has taken an important decision in the cabinet meeting. According to cm Mohd Yadav, in order to put the criminals behind the bars in Madhya Pradesh, the morale of the criminals will be dampened by canceling the bail under section 437, 438, 439 of CrPC. However, after this announcement, such cases have not yet come to notice, in which the police has applied to the court for cancellation of bail.
There is a provision for getting bail in sections 437, 438, 439 of the Code of criminal Procedure CrPC. According to Advocate Virendra Sharma, under Section 438, the suspected accused has the right to get anticipatory bail. Whereas under section 437, bail is granted from the lower court. Similarly, under Section 439, a person gets bail through the Sessions or High court, whom the police accuses of being a criminal. He said that the decision of chief minister Dr. Mohan Yadav is in the interest of the society but the right to grant or not grant bail rests with the Honorable Court.
Advocate Virendra Sharma further said in this regard that although applications for bail are filed under the above sections. He also said that according to the manner announced by the chief minister, the police can file an application for cancellation of bail in the court against the person who has obtained bail. The government has such rights. The final decision on the application will be accepted by the court only.
