In presence of PM and Chandrachud, Kapil said a big thing!


Senior advocate and supreme court Bar Association President kapil sibal on friday (August 30) stressed the importance of empowering trial courts, district courts and sessions courts to deliver justice without any fear or bias. Addressing the opening ceremony of the two-day national conference of the district judiciary, Sibal said that these courts should not be seen as subordinate but as an important component of the justice system.


Sibal said, "They are not subordinate, because they provide justice. Confidence should be created in the judiciary at that level that their decisions will not go against them and they represent the backbone of the justice delivery system."


'Bail is an exception in lower courts'

Reflecting on his long legal career, Sibal expressed concern over the low frequency of bail being granted at the district court level. He said, "In my career, I have rarely granted bail at that stage. It is not only my experience but the CJI has also said so because the high courts are burdened. After all, bail in the lower court is an exception." Sibal said, "Freedom is the fundamental basis of a flourishing democracy and any attempt to disrupt it affects the quality of our democracy." What did CJI Chandrachud say? In his speech, Chief Justice of india Chandrachud called for an end to the colonial-era practice of calling district courts subordinate. He said, "To maintain the backbone of the judicial system, we have to stop calling the district judiciary subordinate judiciary. Seventy-five years after independence, it is time to bury another relic of the british era - the colonial mindset of subordination."
