What is in the decision?

Out of the bench headed by Chief Justice of india DY Chandrachud, CJI DY Chandrachud himself, Justice sanjeev Khanna, JD Pardiwala and Justice manoj mishra have given a decision in favor of maintaining the minority institution status of 'AMU' as per Article 30 of the Constitution. CJI said that any religious community can establish an institution, but cannot run it. The institution can be established as per government rules.

The supreme court said in its decision that aligarh Muslim university (AMU) is entitled to minority status under Article 30 of the Constitution. It further said that Article 30 will be weakened if it applies only to those institutions which have been established after the Constitution came into force. CJI says that the SG has said that the Union is not insisting on the preliminary objection that reference cannot be made to seven judges. It cannot be disputed that Article 30 guarantees non-discrimination against minorities. The question is whether it contains any special rights along with the right to non-discrimination.
