Reservation for Muslims in congress governments

This is about 1993-1994, when andhra pradesh was not divided and telangana was a part of it. At that time, there was a congress government in the state, whose Chief minister was K. bhaskar -Latest Updates, Photos, Videos are a click away, CLICK NOW'>vijay bhaskar Reddy. The then cm formed a Minority Commission, after which it was announced to give 5 percent reservation to Muslims on the report of this commission. 14 other castes were also included in this order. However, this reservation policy could not be implemented in the state as congress lost the 1994 elections and then could not make a comeback in the 1999 assembly elections.

Congress made a comeback in the 2004 assembly elections and YS Rajashekhar reddy became the Chief Minister. congress had promised to give 5 percent reservation to Muslims in the elections itself and implemented it as soon as it came to power. This move of the state government was also fully supported by the Congress-led coalition UPA, which was in power at the Center at that time.

However, many people approached the high court against this decision of the state government. The court ordered that the reservation be limited to 4 percent as it had crossed the 50 percent limit. Those who argued in favor of this said that this reservation was not given on the basis of religion but for the backward classes. The truth is that the entire Muslim community was not included in it and reservation was given separately without crossing the 50 percent limit.

Telugu Desam party, which was in opposition in andhra pradesh at that time, opposed the decision of the congress government. The party argued that reservation on the basis of religion is illegal and it will affect the SC-ST community and other backward castes.

In 2010, the supreme court, while hearing a PIL against it, put a stay on the 4 percent reservation given to Muslims. However, in this order, reservation was continued for those 14 castes which had got reservation along with Muslims. The supreme Court had sent the matter to the constitutional bench, and the matter is still pending.
