Big news has come out in the case of the custodial death of Akshay Shinde, accused in a sexual assault case in Badlapur, Maharashtra. In the magistrate's investigation, five policemen have been held responsible for the encounter of Akshay Shinde. The magistrate submitted the investigation report to the bombay high court on monday (January 20).

What is in the magistrate's report?

The report states that the force used by the five policemen in the fight with the deceased was inappropriate and these five policemen are responsible for the death of the deceased. According to the report, there are no fingerprints of the deceased on the gun, according to the police, he fired the bullet from this gun. The report reveals that the personal defense of the policemen that they fired in self-defense is inappropriate and is under suspicion.

The incident is of august 2024

Akshay Shinde (24) was arrested in august 2024 for sexually assaulting two minor girls inside the toilet of a school in Badlapur. He was an attendant at the school. Shinde died in an encounter while being taken for interrogation from Taloja jail in September. The police had then claimed that he snatched the gun of a policeman travelling in a police van, opened fire and was killed in retaliatory fire. Under the law, a magisterial inquiry is initiated in cases where an accused dies in police custody.

The father had filed a petition

Expressing doubts over the encounter, Akshay Shinde's father Anna Shinde had filed a petition in the High Court. In this, he had claimed that, "His son was killed by the police in a fake encounter."

What did the high court say?

A division bench of Justices Revati Mohite Dere and Neela Gokhale said that the magistrate has come to the conclusion that the five policemen present in the van are responsible for the death of the accused. The bench said that as per the law, an FIR will now be lodged against the five policemen and an investigation will be conducted. The court asked government lawyer Hiten Venegaonkar to tell the bench in two weeks which investigating agency will investigate the case.
