Police permission not required…, rekha Gupta government's big decision!

Delhi's rekha Gupta government took several major decisions on saturday (March 1). An important decision was also taken regarding building construction. In fact, the Ministry of Urban Development has clarified that construction work is controlled by the Municipal Corporation of delhi (MCD) and other local bodies in their respective jurisdictions. There is no need to take permission for building construction from the police.

Under the delhi Municipal Corporation Act, 1957 (DMC Act, 1957), sections 312 and 313 provide for finalizing the layout plan, section 336 for approving the building plan and section 346 for issuing occupancy or completion certificate. It is not mentioned anywhere in these that police permission is required for building construction.

However, some sections under the DMC Act authorize the police to inform the Municipal Corporation about crimes and cooperate in the investigation. These include sections 474, 475 and 466A, under which the police has been given the responsibility to inform the MCD and assist in the investigation of irregular constructions.

Misconceptions spread about police permission

The Urban Development Ministry said that there is no need to take permission from the police for building construction, but there is a misunderstanding about this. Many times this is misused and police permission is unnecessarily sought, which leads to incidents of corruption and illegal recovery. In this matter, delhi police has been instructed to make its field officers aware so that this law is not misused and the public can also get the right information.

The ministry has clarified that even though police permission is not necessary for building construction, it will continue to give full cooperation to the Municipal Corporation and other local bodies in their statutory works. Under Section 475 of the DMC Act, the police has been given the responsibility to assist the Municipal Corporation officials in cases of illegal construction.
