Swati Maliwal: delhi police challenged lower court's decision!

delhi police sought cancellation of the order to give the list of documents to Bibhav Kumar, an associate of former delhi Chief minister Arvind Kejriwal, in the case of attack on swati Maliwal. Justice Vikas Mahajan asked the delhi police lawyer to file a report on his arguments and fixed march 11 as the next date of hearing. delhi police challenged the january 29 order in which the tis hazari court rejected the delhi Police's petition against the magistrate's decision. In which Bibhav Kumar was asked to give a list of documents related to the case.

delhi government's lawyer Sanjay Lao, who was appearing on behalf of delhi police, argued in the court that this order is against the law. He said that the supreme court is already hearing the issue of giving the list of documents related to the case to the accused in another case, so the lower courts should wait for its decision. The lawyer appearing in the court on behalf of delhi police argued that at present the law is present on both sides on this issue. He said that if the supreme court agrees on this matter, then the list of documents will be provided to the accused.

Justice Mahajan in delhi High said that many times it happens that the supreme court takes time to decide on an issue and the matter remains pending. In such a situation, we have to follow the law currently in force. You show me some solid basis to strengthen your argument.

What is the whole matter?

Vibhav Kumar is accused of attacking Maliwal on 13 May 2024 and is currently on bail. tis hazari court took cognizance of the charge sheet filed against him on 30 July 2024. An FIR was registered against Vibhav Kumar on 16 May 2024. Serious charges like criminal intimidation, assault on a woman or use of force with intent to dishonour her and attempt to murder have been leveled against him under sections of the indian Penal Code (IPC). His bail plea was earlier rejected by the trial court and the High Court. After which the supreme court granted him relief.
